Terms of service

Agreement
PlantPhrase is operated by Jerome Francis as an individual, not through an incorporated company. By using PlantPhrase you agree to these terms. If you are using it for an organisation, you confirm you are allowed to accept them on that organisation's behalf. If you do not agree, do not use the service.
PlantPhrase is not agronomic advice
This is the part worth reading twice. PlantPhrase produces estimates from models and from data you supply. It is decision support, not a professional agronomic, horticultural, veterinary, or pesticide-application recommendation, and it does not replace a qualified adviser or your own judgement.
In particular: model outputs depend entirely on the quality and completeness of the readings you provide, disease diagnosis from a photograph is inherently uncertain and we tell you when confidence is low, and any suggestion involving a chemical treatment is subject to the product label and the law where you are. The label and your local regulations always take precedence over anything this service says. You are responsible for decisions you take about your crop.
Beta service
PlantPhrase is in private beta. Features may change or be withdrawn, data models may change, and availability is not guaranteed. We will give reasonable notice before anything that would cause you to lose data.
Your account
Keep your credentials secure and tell us promptly if you think someone else has access. You are responsible for activity under your account. One person or organisation per account; do not share logins.
Your content
Photos, readings and notes you upload remain yours. You grant us the permission we need to store and process them in order to run the service for you — including sending photographs to our vision provider for analysis, as described in the privacy policy. That permission exists to operate the service and for no other purpose.
You confirm you have the right to upload what you upload, and that it does not infringe anyone else's rights.
Acceptable use
Do not attempt to break, overload, or gain unauthorised access to the service or to other users' data. Do not scrape it, resell access, or use it to build a competing dataset. Do not upload unlawful content or anything containing another person's personal data without their consent. We may suspend accounts that do these things.
Our content
The software, models, interface and written material are ours or our licensors'. Using the service does not transfer any of that to you.
Availability
We aim to keep the service running but we do not promise uninterrupted availability, and during the beta there is no service level commitment. We may perform maintenance with or without notice.
Warranties
The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that diagnoses will be correct or that recommendations will produce any particular result for your crop.
Liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, nor for lost profits, lost crops, lost yield, or lost data, arising from your use of the service. Our total aggregate liability is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars (US$100).
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
Ending it
You can stop using the service and delete your account at any time. We may suspend or end your access if you breach these terms, or if we discontinue the service. On termination we delete your data as described in the privacy policy.
Changes
We may update these terms. We will change the date above, and for material changes we will email registered users. Continuing to use the service after a change means you accept it.
Law
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law rules. The state and federal courts located in Texas have exclusive jurisdiction over any dispute arising from them, and you consent to venue there.
